LEGAL
We have appointed an English speaking law firm, Kazmaz Law Offices to represent our clients purchasing in Turkey who are totally independent, and have a wealth of experience in the Turkish market. You are of course welcome to use an independent solicitor to act on your behalf but not only will this more than likely slow down the purchase process but it will probably cost you more.
ABOUT KAZMAZ LAW OFFICES
Kazmaz Law Office was founded in Istanbul in 1988 as an international law firm to provide legal services to foreign, domestic and multi national companies, private individuals and other entities. Today, with joint partnership offices in Istanbul, Bodrum, Didim, Fethiye, Kusadasý, Dalaman and Marmaris, as well as associate offices in Ankara, Izmir & Antalya, the majority of the legal services that we offer to foreigners are mainly dealt with in our Head Office which is located in Bodrum. We also work in close connection with international law firms, mainly in the United Kingdom, Germany, Spain, Portugal and the Netherlands.
Our main philosophy is to provide professional and efficient legal services to our clients whilst complying within the ethical standards that one would expect from respectable international law firm. Closely following the legal regulations within domestic and international law in Turkey, we work alongside the relevant private and public bodies who, like ourselves have years of experience in regulating practices. Kazmaz Law Office is a member of the Turkish British Chamber of Commerce (TBCCI) and Federation of Overseas Property Developers, Agents and Consultants (FOPDAC).
With our in-house specialised lawyers, one of the many services we offer is providing clients with effective and creative solutions within real estate law and the protection of foreign investors’ rights and it’s because of our extensive experience in this area that we execute our services to a substantial international portfolio. At Kazmaz we pride ourselves on strictly adhering to laws on conflict of interest and client confidentiality.
Purchasing Property in Turkey
With the recent surge of interest in the Turkish real estate market, Kazmaz has established a dedicated department with English speaking lawyers to deal with foreigners who are, or require independent advice about, purchasing real estate in Turkey.
Generally the process is relatively straightforward as long as you are prepared with the correct information to start off with.
Our first step is to complete a due diligence investigation, ensuring the legal position of the real estate makes it suitable for purchase. Following this, assuming that the terms of the sales are already agreed and authorised as being legally valid, a purchase contract is drawn up and signed by the relevant parties under the supervision of your lawyer.
Generally a Power of Attorney document is issued at this time so that we can represent our clients at the relevant authorities in Turkey. This also allows us to provide further services which may be required during the process or, where necessary, after the purchase is complete. Please see below for examples of the services we provide.
The time schedule between this and the actual handing over of the property varies greatly depending on the type of real estate to be purchased and generally takes anything from 6 months for a completed property though obviously longer when purchasing off plan.
We strongly believe in the importance of providing our clients with as much detail as possible so that they are aware of every step we make on their behalves.
In order to protect our clients’ best interests at all times, we keep ourselves regularly updated regarding developments in the real estate world locally, nationally and internationally so that we can provide up to date, independent guidance whenever necessary.
